摘 要:高校以章程管理学生,其制定章程的权力来源于国家教育权和高校自治权。由于受相关法律存在欠缺与模糊、高校内部行政权力过分干预、传统教育观念较浓厚等多种因素影响,章程内容多有瑕疵,难以实现维护学生权利的目的。为保证高校自治权的正确行使,应在穷尽高校内部救济的前提下,将高校自治权适度纳入司法审查的范围,并以重要性理论为标准以避免司法过度介入,从而形成一个良性的多元化纠纷解决机制,达到通过程序正义实现实体正义之目的。Colleges and universities manage students by regulations, and their power to formulate regulations comes from the state’s education rights and the autonomy of universities. Because of the lack and ambiguity of relevant laws, the excessive interference of internal administrative power in universities, and the strong traditional education concepts, the contents of the regulations are too flawed to achieve the purpose of safeguarding students’ rights.In order to ensure the correct exercise of university autonomy, university autonomy should be appropriately included in the scope of judicial review under the premise of exhausting the internal remedies of universities, and the importance theory should be used as the standard to avoid excessive judicial intervention, thus forming a benign pluralism dispute resolution mechanism to achieve the purpose of realizing substantive justice through procedural justice.
