摘  要:教育惩戒关涉学校、教师、学生、家长等多个教育关系主体的利益诉求和权责平衡。访谈发现,学校、教师“不敢惩戒”问题尤为突出,正当实施教育惩戒后可能面临的责任风险,是阻碍学校、教师有效实施教育惩戒的突出因素。学校、教师实施教育惩戒的责任风险主要有舆论风险、职业风险和法律责任风险。有效破解“不敢惩戒”的实践困阻,不仅要在立法和司法层面明确教育惩戒的法律权源和责任认定机理,还应当健全教育惩戒责任风险的风险防控与责任分担机制。Educational discipline is related to the interest demands and the balance of rights and responsibilities for some educational relations subjects,such as schools,teachers,students and parents.In practice,the"dare not discipline"problem of schools and teachers is particularly prominent.The liability risks that may be faced after the proper implementation of educational discipline are prominent factors that hinder schools and teachers from effectively implementing educational discipline.The liability risk of schools and teachers mainly include public opinion risk,professional risk and legal liability risk.To effectively solve the practical obstacles of"dare not discipline",we should not only clarify the legal power source and responsibility identification mechanism of educational discipline at the legislative and judicial levels,but also improve the risk prevention,control and sharing mechanism of educational discipline responsibility risk.
