摘 要:教育立法是一项严肃复杂的规范性的决策活动,完备的法律规范体系是法治国家、法治社会的制度基础。中国改革开放四十多年来,高职教育实践取得了丰富发展,而美国高职教育的布局更早、更全面、更完善,相比之下,我国高职教育还存在诸多不足,与建设教育强国的目标相去甚远,在职能定位、体系建设、法制保障、监督管理等方面差距较大。基于对比分析中美两国高职教育法制建设在立法权限、立法程序、法制体系、法制监督的差异,借鉴美国高职教育法制规范的经验做法,揭示我国高职教育法制建设的几点对策建议。Educational legislation is a serious and complex regulatory decision-making activity,and a complete legal system is the institutional basis for a country and a society ruled by law.Over the past 40 years of China’s reform and opening up,the practice of higher vocational education has achieved rich development,while the layout of higher vocational education in the United States is earlier,more comprehensive,and more complete.In contrast,higher vocational education in China still exhibits many shortcomings,which are far from the goal of building a powerful nation in education,and there is a big gap in functional positioning,system construction,legal protection,and supervision and management.Based on the comparative analysis of the differences in the legislative authority,legislative procedure,legal system,and legal supervision in the legal system of higher vocational education in China and the United States,and learning from the experience and practices of the legal system of higher vocational education in the United States,it reveals several strategic suggestions to the legal system of higher vocational education in China.
