摘 要:法典总则是人类法典编纂技术的伟大进步,其作用体现在从一般到特殊的编纂逻辑、更好地统摄法典的全部内容以及能够避免重复性规定,保持法典内容简洁性。教育法典总则编必须确立方法论前提,宜选择体系式编纂模式,采取“序总合一”的体例设计,并将法律关系作为编纂的逻辑主线。在立法技术层面,教育法典总则编应选择相对成熟且符合总分结构要求的提取公因式方法。提取公因式要求总则编从现行教育法和其他教育单行法中发现并提取公因式元素。在章节编排上,我国教育法典总则依次包括教育法基本规定、教育主体概括规定、受教育权与教育权、教育类型、教育法律行为、教育法律责任六大部分。The general provisions of the code aims to arrange the codification logic from general to special,to control the entire content of the code,to avoid repetitive regulations and to maintain the conciseness of the content of the code which are the great advance in the codification technology of human being.The compilation of the general provisions of the education code must establish a methodological premise that is an ideal path to choose a systematic compilation model,to adopt the style design of integration of general rules and specific provisions and to regard legal relations as the logical main line of the compilation.Moreover,as for the level of legislative technology,the general provisions of the education code should choose a relatively mature method of extracting common factors that meets the requirements of the general rules and specific provisions.The extraction of common way requires the general provisions to find out and pick up common factor elements from the current Educational Law and other separate educational regulations.In terms of arrangement,the general provisions of the education code include six parts which are the basic provisions of the education law,the fundamental provisions of the educational subjects,the right to education and the right to choose the education,the types of education,the legal acts of education and the legal responsibilities of education.
