摘　　要：把产教融合纳入法律调整的范围,既是职业教育发展的客观需要,也是《职业教育法》修订的现实需要。从政策供给到法律供给是产教融合制度发展的必然趋势。当前,由于法律制度的缺失,我国产教融合不可避免出现某种失序,集中表现为价值失守、结构失衡和制度失范。产教融合法律调整的逻辑起点在于法律较政策相比的强制性、根本动因在于产教融合失序、构建路径在于修立并举。修订完善《教育法》《职业教育法》等现有法律,把产教融合作为一项基本原则予以规定,制定《产教融合促进条例》单行行政法规和地方法规,是产教融合法律调整的根本路径。Bringing the integration of industry and education into the scope of legal adjustment is not only an objective need for the development of vocational education,but also a practical need for the revision of the Vocational Education Law.From policy supply to legal supply is the inevitable trend of the integration of industry and education system.At present,due to the lack of legal system,some kind of disorder will inevitably occur in the integration of industry and education in China,which is mainly manifested in value loss,structural imbalance and institutional anomie.The logical starting point of the legal adjustment of the integration of industry and education is that the law is more compulsory than the policy,the fundamental reason is that the integration of industry and education is out of order,and the path of construction lies in the simultaneous development of reforms and establishments.Revising and improving the Education Law,Vocational Education Law and other existing laws to provide for the integration of industry and education as a basic principle,and formulating separate administrative regulations and local regulations for the Regulations on the Promotion of Industry and Education Integration,which are the fundamental path adjusted by the law on integration of industry and education.
