摘 要:我国天津、徐州两地在21世纪初颁布的老年教育条例历经近20年的实施,其合法性、协调性、实效性得到了社会的检验与认可,但随着时代的发展,两地条例在合理性、规范性、操作性等方面逐渐显露的问题已明显制约其生命力的延续。而近两年安徽、山东颁布的相关条例在合理性、规范性和操作性等方面虽有所改善,但仍存在没有解决的根本性问题。为保障我国老年教育可持续性发展,可从以下三方面推进老年教育的科学立法与民主立法:一是更新立法理念与目标,重构纲领性条款,提升老年教育立法的合理性;二是提高立法技术与质量,重构法律文本,增强老年教育立法的规范性与科学性;三是加强立法后评估,尤其关注其实效性,提升老年教育立法的质量与效用。After 10 or 20 years of implementation,the two local regulations,enacted by Tianjing Municipality and Xuzhou City of Jiangsu Province in the early 21st century,have been recognized and tested in their legitimacy,coordination,and effectiveness.However,with the development of the era,the loopholes in rationality,standardization,and operability have gradually restricted the continuation of their vitality.Although two other local regulations of Anhui and Shandong Province issued in the latest two years have been improved in rationality,standardization and operation,there are still unsolved fundamental problems.In order to ensure the sustainable development of educational gerontology in our country,the scientific and democratic legislation of the elderly education can be promoted from the following three aspects:firstly,updating the legislative idea and goal,reconstructing the programmatic terms and improving their rationality;secondly,improving the legislative technology and quality,reconstructing the legal provisions,and enhancing their standardization and scientificity;and thirdly,strengthening the post-legislation evaluation,paying special attention to its effectiveness,and ensuring its quality.
