摘 要:近年来,教育惩戒的实施与规制受到广泛关注。已有研究多从单一学科出发,未全面、深刻揭示其本质属性,实施与规制策略系统性、可操作性欠佳。借助知识生产模式转型理论的跨学科性与应用情境,构建多学科融合分析框架。从教育学、法学、管理学视角透视,中小学教育惩戒是集价值追求的教育属性、实施过程的法律属性、现实表征的管理属性于一体的一种教育方式。进而,有效实施与科学规制可从五个方面切入。一是惩戒动机上,基于学生失范行为去除的思想转化;二是细则制定上,基于学校主导的多元民主参与;三是适用程序上,基于违纪事实认定的公平公正;四是具体实施上,基于规则统一的因违纪学生与行为而异;五是权利救济上,基于学生、教师与学校双方权益保障的申诉机制完善。In recent years,the implementation and regulation of education punishment has received extensive attention.Existing studies mostly start from a single subject,fail to fully and profoundly reveal its essential attributes,and the implementation and regulation strategies are unsystematic and poorly maneuverable.With the help of the interdisciplinary and application context of the knowledge production model transformation theory,this study aims to construct a multidisciplinary analytical framework.From the perspective of pedagogy,law,and management,elementary and middle school education discipline is an education method that integrates the educational attributes of value pursuit,the legal attributes of the implementation process,and the management attributes of realistic representations.Furthermore,effective implementation and scientific regulation can be cut from five aspects.The first is the disciplinary motivation,based on the ideological transformation of the removal of anomie behavior;the second is the formulation of the rules,based on the school-led multi-democratic participation;the third is the application procedure,based on the fairness and justice of the violation of the facts;the fourth is the specific implementation,based on the rules that the uniformity differs depending on the students and behaviors that violate disciplines;the fifth is the rights relief,the appeal mechanism based on the protection of the rights and interests of both students,teachers and the school.
