摘　　要：市场监管工作包括执法检查、行政处罚的职能,开展食品安全监管才能充分保障人们的饮食安全。本文讨论了食品监管执法中的谨慎义务,即食品监管执法主体不仅要严格依照法律法规进行执法,还应谨慎地对个案进行分析,考虑其具体情况而精准定性;按照比例原则,斟酌最适当的处罚方式,做到处罚与教育相结合;直面质疑,做好公开释法工作,实现法律效果与社会效果的统一。The market supervision work includes the functions of law enforcement inspection and administrative punishment.Only by carrying out food safety supervision can people’s food safety be fully guaranteed.This paper discusses the duty of prudence in food supervision and law enforcement,that is,the subject of food supervision and law enforcement should not only enforce the law in strict accordance with laws and regulations,but also carefully analyze the case,consider its specific situation and accurately determine the nature;according to the principle of proportionality,the most appropriate punishment method should be considered to achieve the combination of punishment and education;face the challenge directly,do a good job of public interpretation,and realize the unity of legal effect and social effect.
