摘 要:新冠肺炎疫情期间,为保障教学秩序与师生的生命安全,美国高校纷纷将面授教学改为在线教学。但学生却认为,在线教学质量低下,无法与面授教学媲美,由此爆发了大规模在线教学案件。通过分析107件美国高校在线教学案件可以发现,案件争议焦点主要聚焦于将面授教学改为在线教学是否涉嫌教育失职、不当得利、违反合同、侵犯权益和财政转移等问题。虽然由于各州法律、判例、法官研判等原因,案件的审判结果略有差异,但是各类案件的核心问题均在于美国高校学生认为在线教学的质量远低于面授教学。新冠肺炎疫情作为典型的黑天鹅事件,凸显了美国高校在线教学的质量保障与质量评价问题。To protect the instruction order and lives of students and faculty during the COVID-19,American colleges and universities have switched face-to-face instruction to online instruction.However,students believe that the quality of online instruction is low and not comparable to face-to-face instruction,causing a large number of online instruction cases.An analysis of 107 cases of online instruction in American colleges and universities reveals that the controversies in the cases focus on whether the conversion of face-to-face instruction to online instruction is suspected of educational misconduct,unjust enrichment,breach of contract,infringement of rights and interests,and financial conversion.Although the outcome of the cases varied slightly due to state laws,jurisprudence,and judges'judgment.The core problem in various cases is that American college and universities students believe that the quality of online instruction is far lower than face-to-face instruction.As a typical black swan event,the COVID-19 epidemic has exposed the quality assurance and evaluation of online instruction in American colleges and universities.
