中国法律典籍翻译研究中的“三大范式”及其研究展望

摘　　要：梳理中国法律典籍翻译研究现状和研究特征,能够为法律典籍翻译研究领域的发展提供方向。以翻译研究中的范式为理论视角,采用归纳法,通过哲学分析,透视法律典籍翻译研究的本质特征,发现目前中国法律典籍翻译研究中存在“三大范式”,不同研究范式具有不同的研究对象、研究方法、哲学基础、学术共同体以及领军人物。通过对法律典籍翻译研究前景的展望,既拓展和提升这一领域学术研究的理论价值,也发挥出中国特色社会主义法治文化国际传播的实践价值。This article attempts to make summary of the status quo and characteristics of translation studies on Chinese traditional legal classics and gives the direction for the development of this research field.Starting from the theoretical perspective of paradigms in translation studies,this research,by the inductive method and through philosophical analysis,probes into the intrinsic characteristics of translation studies on traditional legal classics.It concludes that there exists three paradigms of translation studies on Chinese traditional legal classics with distinct research objects,methods,philosophical foundation,academic community and leading scholars for each paradigm.Through reflecting the research prospects of translation studies on traditional legal classics,this article tries to extend and elevate the theoretical value of the academic studies in this field and bring into full play the practical value of improving the influence of international communication of socialist rule of law culture with Chinese characteristics.
