摘 要:梳理我国近20年来的相关研究文献,发现学界围绕中小学教师教育惩戒权基本理论问题、实践问题、立法问题及教育惩戒权等方面的相关论争展开了一系列研究,并取得了较为丰硕的研究成果。深入分析文献发现,我国关于中小学教师教育惩戒权的研究缺乏整合性,还存在形式细则不够明确、量化的实证性的交叉学科研究较为欠缺、探讨国外中小学教师教育惩戒权的深度不够等问题。基于此,从加强多学科研究的视角,就进一步加强实施细则的研究,增加实证研究及重视对国外相关法律的借鉴研究等方面,对中小学教师教育惩戒权的未来研究进行展望,以期不断丰富我国教育惩戒权的理论研究与实践探索。By combing the relevant research literature in China in recent 20 years,it is found that the academic circle has carried out a series of studies on the basic theoretical issues,practical issues,legislative issues and related disputes of primary and secondary school teachers' right of discipline,and has achieved fruitful research results.However,through an in-depth analysis of the literature,it is found that the research on primary and secondary school teachers' right of discipline in China lacks integration,the formal rules are not clear enough,quantitative empirical interdisciplinary research is deficient,the exploration of foreign primary and secondary school teachers' right of discipline is not enough.On this basis,from the perspective of strengthening multidisciplinary research,future research on primary and secondary school teachers' right of discipline is prospected on aspects of further strengthening the research on implementation rules,increasing empirical research and attaching importance to the reference research of relevant foreign laws,in order to continuously enrich the theoretical research and practical exploration of right of school discipline in China.
