摘　　要：所谓情理,就是基于正当合法的欲望,经由对事实的准确认识和评价,生发出的情感之理。情感生发的过程,是包含理性运作的过程。作为一种情本体文化,中国文化所谓天理,就是这种情感之理。而所谓情理司法,就是基于这种情理精神,以正当合法的欲望为前提,以对案件事实的准确认知和评估为基础,运用认知和评估的理性能力,以合乎天理为价值取向的司法模式。实现司法裁判的情理圆融,必须对案件事实进行正确的认知和评价,避免错误的情感和案件无关情感;必须将情感建立在正当合法欲望的基础上,避免过头和麻木的情感。The so-called qingli(emotional justice)is the emotional reason,which is based on the legitimate desire,and emerges through the accurate cognition and evaluation of the facts.The process of emotional development is one that includes the operation of the rational process.The so-called tianli(natural reason)in Chinese culture,as a kind of emotional ontology culture,is this emotional reason.The so-called emotional justice is a judicial mode which is based on the spirit of this emotional justice,takes the legitimate desire as a precondition,builds on the accurate cognition and evaluation of the facts of the case,uses the rational ability of cognition and evaluation,and adopts the value of conforming to natural reason.In order to achieve the harmony of emotion and reason in judicial decision,we must make correct cognition and evaluation of the facts of the case,avoiding wrong emotion and irrelevant emotion;we must base our emotion on legitimate and lawful desires,avoiding excessive and numb emotion.
