摘　　要：2021年联合国教科文组织发布的《共同重新构想我们的未来:一种新的教育社会契约》报告中指出,受教育权是新的教育社会契约的权利基础。相较于以教育机会为核心的公平受教育权而言,优质受教育权契合教育的数字化转型、高质量追求与整体性保障需求,在教育的人权保障范式、射程范围以及发展权能等方面具有明显的优越性,作为智慧教育社会契约的权利基础更具合理性。应充分发挥优质受教育权作为基本权利的防御权功能与受益权功能,对智慧教育选择、机会、条件与信息技术利用能力等方面进行保障,并构建起以优质受教育权为核心的客观价值秩序,强化智慧教育的制度性保障、组织保障与程序保障。In 2021,UNESCO launched the report“Reimagining our futures together:A new social contract for education”,which pointed out that the right to education is the right basis of the new social contract for education.Compared with the fair right to education centered on educational opportunities,the right to quality education meets the practical needs of the digital transformation,the pursuit of high quality and the overall guarantee of education.Right to quality education has obvious advantages in the human rights guarantee paradigm,the range of education and the development of empowerment,and is more reasonable as the right basis of the social contract of smart education.The right to quality education,as the right basis,should give full play to the function of defensive right and the function of beneficial right,and guarantee the choice,opportunity,condition,and information technology utilization capability of smart education.Eventually,we should build an objective value order with the right to quality education as the core,and strengthen the institutional,organizational and procedural guarantees for smart education.
