摘  要:重德政而不重刑罚。这是汉代董仲舒对德刑关系的看法。针对汉初因袭秦朝“刑治”所带来的弊政,董仲舒重申了儒家的德治理念,提出“任德不任刑”的法律主张。他认为君主应当实施德政,以教化作为治国的主要手段,而不应一味使用刑罚。随着儒家思想在汉代政治中的不断强化,“任德不任刑”直接促进了古代道德与政治的融合。Morality-ruling over penalty-ruling is the view of Dong Zhongshu,a scholar of the Han Dynasty,on the relationship between virtue and punishment.To deal with the drawbacks of“penalty-ruling”passed down from the Qin Dynasty to the earlier Han Dynasty,Dong reiterated the Confucian concept of“morality-ruling”and proposed“morality-ruling over penalty-ruling.”He believed that emperors should adopt moral rule,with moralization as the primary means of governance and that they should refrain from solely relying on punishment.Since Confucianism played a pivotal role in politics in the Han Dynasty,the concept sped up the integration of morality and politics in ancient China.
