摘　　要：《民约译解》是中江兆民对《社会契约论》的汉文译本,它对卢梭民主思想在中国和日本的传播影响深远。对比之下,可发现译文对原文存在“创造性叛逆”;但其差异实质上是双重的:既将儒学观念用于《契约论》的译介中;也利用《契约论》对儒家义理进行改造,使东西方观念在对话中同时介入对日本近代民主思想的构建。《译解》的传播也影响到中国近代对卢梭契约论的接受和民主观念的形成。为探究这种差异如何形成,首先介绍了《民约译解》的译介背景和传播情况,然后对《译解》和《契约论》中有所区别的典型概念和思想结构进行了比较,进而在东西方文化信仰的不同构造中探其根基。从而阐发了两个文本间的对话性及其对当下东西方交流的启发性。The Interpretation of the Civil Covenant is the Kanji translation of the Social Contract by Chomin Nakae,which played an important role in the dissemination of Rousseau’s democratic thought in China and Japan.By comparison,it can be found that the translation exhibits“creative rebellion”against the original text,but the differences are essentially dual:on the one hand,Confucian concepts are used in the translation of“Contract Theory”;At the same time,the Contract Theory was also used to transform the Confucian doctrine,allowing Eastern and Western concepts to simultaneously intervene in the construction of Japanese democratic thought in dialogue.The dissemination of“Translation”also influenced the acceptance of contract theory and the formation of democratic concepts in modern China.To explore how these differences are formed,the translation background and dissemination of the Interpretation of the Civil Covenant are first introduced.Then,typical concepts and ideological structures that differ between the Interpretation and the Contract Theory are compared,and their foundations are explored in the different constructions of cultural beliefs in the East and the West,thus elucidating the conversational nature between the two texts and their enlightening implications for current East West communication.
