摘 要:当前,我国法律职业伦理教学面临困阻,教学目标不能很好的实现。其中原因之一在于教学方法不够完善。在各类教学方法中,案例教学法应在法律职业伦理教学中处于关键地位。但是,部门法中的案例教学法在法律职业伦理教学中缺乏足够的适用空间,而法律职业伦理课程本身又未形成体系化、可复制推广的案例教学法。为此,应将法律职业伦理案例划分为行为事迹类案例与规范适用类案例,针对前者应当适用“评价分析式”案例教学法,针对后者应当对三段论进行丰富改造,增加角色拟定、组织讨论与辩论等“组合式”案例教学法的应用,同时,可以通过课堂观察以及举办法律职业伦理短视频大赛等形式检验案例教学法的授课效果。此外,亦要在“双师同堂”中增强教师与实务导师的课前沟通、加强教师对实务导师的授课引导以及稳定实务导师队伍。At present,the legal professional ethics teaching in China is facing obstacles,and the teaching objectives cannot be well realized.One of the reasons is that the teaching methods are not perfect.Among all kinds of teaching methods,case method should be the key position in the legal professional ethics teaching.However,the case method in sectoral law lacks sufficient space for application in the legal professional ethics teaching,and the course of legal professional ethics itself has not formed a systematic and reproducible case method.For this reason,legal professional ethics cases should be divided into cases of behavioral deeds and cases of normative application.For the former,the“evaluation and analysis”case method should be applied,and for the latter,the syllogisms should be enriched,and the“combined”case methods such as role-play,and organization of discussion and debate should be added.At the same time,the teaching effect of the case method can be examined by classroom observation and the organization of a short-video competition on legal ethics.In addition,it is also necessary to enhance the pre-course communication between teachers and practical instructors,strengthen the guidance of teachers to practical instructors,and stabilize the team of practical instructors.
