教育惩戒权合法性回归的问题与纾解

摘  要:《中小学教育惩戒规则(试行)》的颁布使教育惩戒权实现合法性回归,有利于健全学校教育管理,促进学生形成正确社会认知和行为范式。然而在教育实践中,出现了属性之争悬而未决、惩戒标准模糊不清、师生地位差异显著以及舆论压力持续加剧的现实问题,严重阻碍教育惩戒权发挥应然效用。“维护教师教育惩戒权,支持教师积极管教”意义重大。为此,应坚持为国为教的价值导向,明确求真求善的惩戒动机,确立爱师爱生的平等关系,统一合情合法的理性认知,合力解决教育惩戒权的实施问题。The promulgation of the Rules for Discipline in Primary and Secondary Schools(for Trial Implementation)has enabled the legitimate return of the right to educational punishment,which is conducive to improving school education management and helping students develop correct social cognition and behavioral paradigms.However,in educational practice,there are practical problems such as the unresolved disputes over attributes,ambiguous punishment standards,significant differences in the status of teachers and students,and the continuously intensifying public opinion pressure.These problems seriously hinder the proper exertion of the due effect of the right to educational punishment.“Safeguarding teachers’right to educational punishment and supporting teachers’active discipline”is of great significance.Therefore,we should adhere to the value orientation of serving the country and education,clarify the punishment motivation of seeking truth and goodness,establish the equal relationship of loving teachers and students,and unify the rational cognition of being reasonable and legal,so as to solve the problems in the implementation of the right to educational punishment.
