终身教育地方立法的价值意蕴、理念原则与路径选择

摘　　要：建设全民终身学习的学习型社会需要高质量的教育法治体系提供法治保障。国家层面的终身教育基本法长期处于迟滞状态,迫切需要各地因地制宜进行终身教育立法,以满足终身教育法治现代化的发展需求。终身教育地方立法宜以保护公民终身学习权为核心,合理运用立法技术,精准诠释立法的理念原则和主要内容。为避免可能存在的法律矛盾,宜采取广义的终身教育概念,将立法的调整范围界定为社会教育领域,并选用“终身学习促进”作为立法名称。为增强立法规则的可操作性,应当明确终身教育法律关系主体的职责权限,建立与保障公民终身学习权相匹配的公共服务保障体系。同时,为推动区域平衡充分发展、促进教育公平,有必要积极探索终身教育区域共治共同立法模式。To build a learning society with lifelong learning for all requires a legal system of high-quality education to provide a legal guarantee.The basic law of lifelong education at the national level has been in a state of stagnation for a long time,and it is urgent to formulate legislation on lifelong education according to local conditions to meet the development needs of the modernization of the rule of law in lifelong education.Local legislation on lifelong education should focus on the protection of citizens’right to lifelong learning,make rational use of legislative technology,and accurately interpret the concepts,principles and main contents of legislation.In order to avoid possible legal contradictions,it is advisable to adopt the generalized concept of lifelong education,define the adjustment scope of legislation as the field of social education,and choose“lifelong learning promotion”as the name of legislation.In order to enhance the operability of the legislative rules,the responsibilities and powers of the legal subjects of lifelong education should be clarified,and a public service guarantee system that matches the protection of citizens’lifelong learning rights should be established.At the same time,it is necessary to actively explore the joint legislation mode of regional co-governance of lifelong education,in order to promote regional balance and full development and promote educational equity.
