摘 要:由于社会转型所引发的国家与社会关系变化,传统的教育法部门法定位学说开始面临新的挑战。为此应以跨部门法律观重新审视教育法的定位问题。跨部门法律观强调突破传统部门法学的思维定式,主张尊重教育法的异质性特征,力倡公法规范和私法规范的相互配合和平衡,对于解释教育领域的法律现象和法律问题表现出独特的优势和贡献。应以跨部门法律观来推动教育法学学科建设,在重新认识和理解受教育权的基础上建构教育法学的学科体系和知识体系,以跨学科的研究方法来繁荣教育法学研究。The transformation of state-society relations triggered by social transition has posed new challenges totraditional theories regarding the discipliary positioning of the field of education law.This necessitatesre-examining the positioning of education law through an inter-departmental legal perspective.This perspectiveadvocates transcending the stereotyped mindset of traditional departmental jurisprudence,emphasizes respectingthe heterogeneous characteristics of education law,and promotes the coordination and balance between publiclaw norms and private law norms.It demonstrates unique advantages in interpreting legal phenomena andaddressing legal issues within the educational domain.To advance the disciplinary construction of education law,an inter-departmental legal perspective should guide the establishment of its disciplinary and knowledge systemsgrounded in a renewed understanding of the right to education.Additionally,interdisciplinary researchmethodologies should be employed to enrich education law studies.
