摘 要:完善中小学教师退出机制是建设素质精良教师队伍的重要举措。当前有关教师退出的政策偏重以在编不合格教师为退出主体、以重大失范为主要退出标准、以刚性辞退为主要退出形式。这种管理主义的政策取向未能充分关注到教师退出过程中所涉及的一系列教师权益。这种对教师权益保障的缺憾主要体现在辞职规范的真空、退出后经济保障的相对不足以及程序正义的缺乏。为完善教师退出机制,需要面向所有教师制定统一退出标准、合理规范教师的二次辞职权、建立聘任合同到期原则续聘制度以及教师考核监督与救济制度。Improving the withdrawal mechanism for primary and secondary school teachers is an important measure to build a high-quality teaching team.The current policy on teacher withdrawal focuses on unqualified teachers as the main subject of withdrawal,major misconduct as the main criterion for withdrawal,and rigid dismissal as the main form of withdrawal.This management-oriented policy orientation has not fully paid attention to the series of teachers'rights and interests involved in the process of teacher withdrawal.The shortcomings in the protection of teachers'rights and interests are mainly reflected in the vacuum of resignation regulations,the relative lack of economic security after withdrawal,and the lack of procedural justice.To improve the teacher withdrawal mechanism,it is necessary to establish a unified withdrawal standard for all teachers,rationalize the right of teachers to resign twice,establish a system for renewing employment contracts based on the principle of expiration,and establish a system for monitoring and remedying teacher evaluations.
