从“缺位”到“补位”:我国继续教育发展困境与立法出路

摘  要:继续教育作为终身学习的重要组成部分,对于提升国民素质、实施人才强国战略具有重要作用。我国继续教育在国家层面的立法缺位,导致职业教育、高等教育、继续教育协同创新中出现“脱嵌”现象。继续教育的立法缺失源于国家顶层设计不足、立法研究理论滞后、现有规范位阶较低,在概念术语、理论范式、分析框架等方面没有形成共识性的理论体系。我国继续教育的发展应注重顶层设计,补位国家层面继续教育立法;加强理论研究,积累继续教育地方立法经验;补齐立法短板,构建职业教育、高等教育、继续教育协同创新法律体系。通过借鉴国外立法经验并进行本土化转化,推动我国继续教育立法进程,以实现党的二十大报告提出的“统筹职业教育、高等教育、继续教育协同创新”的目标,开创职业教育、高等教育、继续教育协同创新的可持续发展新局面。As an important part of lifelong learning,continuing education plays an important role in improving national quality and implementing the strategy on developing a quality workforce.The absence of legislation on continuing education in our country at the national level leads to the phenomenon of“decoupling”in the collaborative innovation of vocational education,higher education and continuing education.The lack of legislation in continuing education stems from the lag of legislative research,the low level of existing norms and the deficiency of national top-level design and there is no consensus theoretical system in terms of concepts,theoretical paradigms and analytical frameworks.Therefore,the development of continuing education in our country should pay attention to the top-level design and replace the national level of continuing education legislation.Strengthen theoretical research and accumulate local legislative experience.Make up for the shortcomings of legislation and build a legal system for the collaborative innovation of vocational education,higher education and continuing education.By learning from foreign legislative experience and carrying out localization transformation,we can promote the legislative process of continuing education in China,so as to realize the goal of“collaborative innovation of vocational education,higher education and continuing education”proposed in the report of the 20th National Congress of the Communist Party of China,and create a new situation of sustainable development of collaborative innovation of vocational education,higher education and continuing education.
