高职院校生产性实训基地运行法律问题探讨

摘　　要：高职院校生产性实训基地是具有真实经营功能的校内实训基地,由于其经营性特征在运行过程中出现了很多法律问题,包括劳动关系问题、劳动报酬问题、人身意外赔偿问题、工商许可和税收等问题,这些法律问题影响着生产性实训基地的正常运行。提出了生产性实训基地要依法运行、提升其法律教育功能;要明晰产权,明确生产性实训基地的独立法人地位;要运用法律手段减少其运行风险。Productive training in higher vocational college is training base with real operating function. There are many law problems during operating due to productive characteristic, which include labor relationship problems, labor reward problems, body unexpected indemnify, authority of industry and commerce and tax problems. These problems influence that productive training base operates regularly. The paper points out that productive training base should operate according to law and promote its law education function; its property right should be definite and be independent legal entities. We should apply law means to reduce its law risks.
