多样化校企合作模式的法律解构

摘　　要：校企合作是职业教育的人才培养模式,具体的校企合作模式呈现出多样化,校企合作的组织形式和合作行为涉及到学生的权利与义务,学生是合作的主体一方,立法明确之前,实务对合作企业与学生之间的法律关系可参照劳动关系处理。以校企合作协议书建立合作关系是较为典型的校企合作模式,但执行具体的合作事项应另行细化约定。School-enterprise cooperation is the talent cultivation mode, with specific school-enterprise cooperation modes diversified. However, the forms and cooperation behaviors of the cooperative organizations involve students＇rights and obligations, with the students as one party of the cooperation. In practice the legal relations between the eooperative enterprises and students can refer to the labor re- lationship before clear legislation is done. School-enterprise cooperation agreement to establish cooperation relationship is a typical school-enterprise cooperation mode, but to carry out a specific cooperation matters should be further agreed in detail.
