摘　　要：高等学校实行依法治校不仅是现代高校管理的基本要求 ,也是一个重大的价值选择。在明确几个前提和界定概念之后 ,阐释了高等学校依法治校的宪政基础与应正确理解的两对关系 ,即治校权与教师权、学生权的关系 ;治校权与法的关系。在分析了高等学校依法治校的基本特征后 ,探讨了高校党委在依法治校中的作用。The implementation of the running of the university by law is not only a basic requirement of modern administration of university but also an important value choice.After making some presupposition clear and defining concepts,the article expounds the constitutional government base and two relations that we should understand correctly,that is,the relation between the power of running the university and the rights of teachers and students,the relation between the power of running the university and law.The anthors explore the role of Party committee in running the university according to law after the analysis of its essential features,and finally propose several measures to advance running of the university under law
