摘 要:司马迁在《史记》中对法家思想以及法家人物的评价非常明显。他在《史记》论赞中的对法家思想、人物以及行事的评价,蕴含了自己理想的社会运行模式、即支持德治为主、法治为辅的管理模式、提倡简约宽缓的法令条文、向往醇厚朴实的社会状态;对法家思想具有道德评价和历史评价的双重思想倾向。通过对执法者个人命运的关注凸显自己鲜明的道德评价视角,折射出司马迁作为一位儒、道思想影响下成长起来的史学家对法家学说复杂而矛盾的态度。Sima Qian's on the evaluation of legalism and legalists is particularly evident in The Historical Records. He implied his ideal mode of social operation,that is,the mode of management supported by the rule of law and supplemented by the rule of law,and advocated simple and lenient decrees and articles,as well as a mellow and simple social state. The law of thought has a moral and historical evaluation of dual ideological tendencies. By focusing on the fate of law enforcers,and as a Confucian and Taoist historian who grew up under the influence of Confucianism and Taoism,he highlighted his distinctive perspective of moral evaluation and reflected the complex and contradictory attitude.
