摘 要:在美国,基于血缘关系的亲权以及《宪法》的第十四修正案的正当程序条款的“自由保护”有关内容对家庭教育权的确立提供了依据;同时,法院通过判例对家庭教育权进行了维护。美国的家庭教育权的内容包括:教育内容选择权以及具备指导子女在家上学的权利。美国联邦和州政府都对家庭教育权进行了各种形式的监督和约束,不仅在立法上进行了详细的规定,而且从联邦到地方还设有监督机构。In the United States,parental authority based on blood relationship and the"protection of liberty"of the Due Process Clause of the Fourteenth Amendment to the Constitution provide the basis for the establishment of the family educational rights;At the same time,the court has safeguarded the family educational rights through precedents.The content of family educational rights in the United States includes:the right to choose educational content and the right to instruct children to go to school at home.Both the federal and state governments in the United States have carried out various forms of supervision and restraint on the family educational rights.Not only have they made detailed provisions in legislation,but they have also set up supervisory agencies from the federal government to the locality.Supervision was carried out.
