摘 要:加快国家层面的终身教育立法,是推动终身教育理念普及及政策推进的重要举措,也是实现建设服务全民终身学习教育体系目标的必要保障。但关于立法的核心概念到底是使用“终身教育”还是“终身学习”,目前仍存在争议。故明晰概念内涵、厘清发展思路,对立法者的预测判断及决策意图的形成意义重大。但就现状而言,无论是立“终身教育法”还是“终身学习法”,均需关注四个问题:一是立法的根本目的必须以满足学习者的终身学习需求为宗旨,这也是基本原则,不可动摇;二是透过概念的争议,需要看清其背后关乎的乃是“教育”与“学习”的本质论辩与理解;三是需要把握当前终身教育发展的现状与未来需要突破的难点,由此明确立法重心;四是如以“终身学习”为名立法,则需注意因理念认识不够深入或理解偏颇而导致立法宗旨的异化。Speeding up the legislation of national lifelong education is an important measure to promote the popularization of the concept and policy of lifelong education,and also a necessary guarantee to achieve the goal of building a lifelong learning education system for all. However,there is still controversy as to whether the core concept of the legislation should use“lifelong education”or“lifelong learning”. Therefore,it is of great significance to clarify the concept connotation and the development thinking for the legislative makers to judge the pros and cons and form the decision intention. As far as the current situation,whether the“lifelong education law”or the“lifelong learning law”is concerned,there are four issues. First,the fundamental purpose of legislation must be to meet the lifelong learning needs of learners,which is also the basic principle that cannot be shaken. Second,through the controversy of concepts,it is necessary to understand the essence of "education" and "learning".Thirdly,it is necessary to grasp the current situation of lifelong education development and the difficulties that need to be broken through in the future,so as to clarify the focus of legislation. Fourthly,if the legislation is made in the name of“lifelong learning”,it is necessary to guard against the alienation of the legislative purpose caused by the insufficient understanding of the concept or the biased understanding.
