摘　　要：以岗位实习职校生的双重身份为逻辑起点,深刻分析当前以民法为重心的权益保障模式在制度框架与实际运用中的困境,立足“教育与生产劳动相结合”理论,尝试重新引入劳动法规制手段,建构“一体两维”的权益保障模式,从劳动法与民法两个维度全面保障岗位实习职校生的合法权益。Taking legal identity of internship students from vocational schools as the logical starting point,existing equality protection mode cornering on civil laws is analyzed with the theory of combining education with work to explore a“two in one”path for the internship equality protection mode of vocational school students.The legal rights and interests of vocational school students will be fully protected from the dimensions of labor law and civil law.
