我国职业院校学生权利保障的法律责任分析

摘　　要：职业院校学生作为职业教育教学活动的主体,依法享有和普通院校学生同等的权利。但职业院校有其自身的独特性,相应地,学生权利也具有职业院校的特色。随着国家法制化进程的发展和依法治教的不断完善,职业院校学生权利的内容不断地得到丰富和加强。然而《职业教育法》和相关法律、法规仍然存在着对职业院校学生权利保障主体责任模糊、救济机制欠缺等问题。应从立法方面强化和保护职业院校学生权利、明确保护主体的法律责任、完善职业院校学生权利救济机制等方面着手构建职业院校学生权利保障机制。As the main body of vocational education activities,vocational college students enjoy the same rights as other ordinary college students. But because of the characteristics of vocational colleges,the students＇ rights also have the characteristics of vocational colleges. With the development of the lega process and improvement of administering education according to the law,the content of the vocational colleges students rights have been constantly enriched and strengthened. However,in the vocational education law and relevant laws and regulations,there still exists problems such as unclearness of students＇ rights for vocational college,lack of relief mechanism and so on. Therefore,the rights of vocational college students should be strengthened and protected from the perspective of legislation,the subject of legal liability protection should be defined,vocational college students＇ rights remedy mechanism should be perfected,and the vocational college students＇ rights protection mechanism should be established and improved.
